BREAKING: Protect Women And Children Turns In More Than 205,000 Signatures To Put The Measure On The Ballot!

The abortion industry is attempting to enshrine a right to abortion in the Nebraska Constitution with a ballot initiative that would legalize abortion until birth, subject preborn children to painful late-term dismemberment abortions, put girls at greater risk for human trafficking, and eliminate parental notification requirements. Since the overturn of Roe v. Wade, the abortion industry has won in all seven states where abortion has been on the ballot, and abortion advocacy groups are spending millions of dollars to confuse and mislead voters.

We must turn the tide, so local pro-life leaders, medical professionals, and legal experts responded with a counter pro-life initiative to protect our current 12-week law and allow greater protections going forward.

Both ballot initiatives collected enough signatures to qualify for the November election, and the Nebraska Secretary of State is currently verifying the signatures.

Life is a human right, and women, children, and families in Nebraska deserve real love and support, not dangerous proposals that jeopardize the health and safety of women and end the lives of precious baby boys and girls. Nebraska is a pro-life state, and our laws should reflect our pro-life values.

Our state is at a crossroads, and in 2024, Nebraska voters will decide: Will we be the first state to defeat the abortion industry and establish basic constitutional protections for preborn children?

WHAT THE LANGUAGE SAYS

“Except when a woman seeks an abortion necessitated by a medical emergency or when the pregnancy results from sexual assault or incest, unborn children shall be protected from abortion in the second and third trimesters.”

WHAT THIS MEANS FOR NEBRASKA

Establish Constitutional Protections For Preborn Children
The initiative creates basic constitutional protections for preborn children in Nebraska. If passed, Nebraska would be the first state in the nation to provide constitutional protection to preborn children in a state constitution.

Allow For Greater Protections Going Forward
This initiative establishes a floor of protection, not a ceiling, meaning preborn children must, at a minimum, be protected by the second trimester, and stronger pro-life laws could still be passed going forward.

Protect Nebraska’s Current 12-Week Law
Constitutional protections are much harder to undo than state statutes. The initiative language is consistent with the bill passed by the Nebraska Legislature in 2023 to prohibit abortion at 12 weeks, and it ensures that our existing pro-life laws remain in place while we continue working to create a culture of life that provides love and support to every mother and child.

WHAT THE LANGUAGE SAYS

“All persons shall have a fundamental right to abortion until fetal viability, or when needed to protect the life or health of the pregnant patient, without interference from the state or its political subdivisions. Fetal viability means the point in pregnancy when, in the professional judgment of the patient’s treating health care practitioner, there is a significant likelihood of the fetus’ sustained survival outside the uterus without the application of extraordinary medical measures.”

WHAT THIS MEANS FOR NEBRASKA

Broad Exceptions
The initiative contains a vague “health exception” determined entirely by the abortionist. Exceptions could include non-physical factors, such as emotional, spiritual, and financial health. This opens the door to abortions up until birth.

Late-Term Abortions
Viability is defined as being based solely on the abortionist’s judgment and would allow abortions in the second and third trimesters. Babies feel pain before viability—at 15 weeks or earlier. Babies who can experience pain would be subjected to painful late-term abortions.

No Parental Consent
The initiative creates a fundamental right to abortion for “all persons,” including children and minors. This would eliminate our state’s parental consent law, meaning parents will not have any ability to consent or even know if their child seeks or obtains an abortion.

Protections Eliminated
A “fundamental right to abortion without interference from the state” puts existing medical safeguards that protect the health and safety of women at risk of being eliminated. This includes informed consent statutes and requirements that the abortion be performed in person and by a licensed doctor.
