Senator Kauth just introduced a bill in the Legislature to protect girls’ sports and private spaces.
The “Stand With Women Act” is designed to safeguard the rights, opportunities, privacy, and safety of women and girls in Nebraska by establishing simple, sex-specific standards in sports, schools, and state facilities.
LB 89 is a necessary measure to protect women and girls in Nebraska at a time when female athletes are being displaced from podiums at every level of competition.
In 2020, Idaho passed protections for girls’ sports, and since then, numerous states have followed. It’s time for Nebraska to safeguard women’s rights to privacy, protect female athletes from unfair competition, and preserve opportunities designed specifically for them.
Why This Matters
Studies consistently show that biological males have inherent physical advantages over females, including greater bone density, muscle mass, and cardiovascular capacity. These differences make male participation in girls’ sports unfair and unsafe.
Without laws like the “Stand With Women Act,” female athletes risk significant bodily injury and lose opportunities to compete, earn scholarships, and excel in their fields. Allowing biological males to compete in female sports robs girls of opportunities and achievements they’ve worked hard to attain.
What The Bill Does
Women deserve fair competition and privacy. LB 89 takes a commonsense approach to protect the privacy of students and citizens in restrooms and locker rooms and preserve the integrity of female sports.
Key components of LB 89:

- Fair Competition in Sports: Schools and athletic associations must categorize teams as male, female, or co-ed, ensuring that female sports are reserved exclusively for female athletes.
- Privacy Protections: Access to restrooms, locker rooms, and showers in schools and state facilities must be based on biological sex, except in specific emergency or maintenance situations.
- Consistent Definitions: Establishes definitions for “male” and “female” based on biological sex to provide consistency across state laws, regulations, and programs.
- Expanded Protections: Measure extends to public colleges, universities, and state agencies, including prisons and correctional facilities.
No girl should lose her chance to compete, feel unsafe at school, or be forced to share bathrooms and locker rooms with biological males. This bill not only protects K-12 students but also ensures fairness and safety at our colleges, universities, and state-run facilities.
Protecting our girls’ sports and privacy isn’t just about fairness; it’s about standing up for truth and preserving opportunities for the next generation of Nebraska women.
